Introduction

These terms and conditions govern your use of this software/website; by using this oftware/website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this software/website. You must be at least [18] years of age to use Kare4U software/website. By using this Kare4U software/website [and by agreeing to these terms and conditions] you warrant and represent that you are at least [18] years of age.

This software/website uses cookies. By using this software/website and agreeing to these terms and conditions, you consent to our Kare4Usoftware/Website use of cookies in accordance with the terms of Kare4U/website privacy policy/cookies policy.

1. Kare4U:

Kare4UHealthcare Solutions Private Limited (“Kare4U“) is the author and publisher of the software Kare4U (including all files and images contained in or generated by the software, and accompanying data, together with the “Software“). Kare4U also operates the internet resource www.Kare4U.in (Website) on World Wide Web which is used to access Kare4U Software. Kare4U Software is developed focusing on HealthCare domain predominantly, to bring systems and processes in Indian Healthcare that creates a platform for better overall experience for both Provider (hospitals, doctors, diagnostic centres, medical labs and pharmacies and any personnel associated with these organizations) and Consumer (common human, patients, doctors, anyone with access to the Kare4U) and the same help to find, manage and organize information regarding doctors, hospitals, pathology laboratories, diagnostic centres, medical labs, blood banks along with appointments, prescriptions, medical information, medical records, billing, inventory and accounting detail sets.  

2. Protection of customer data by Kare4U:

2.1 – Kare4U provides its services in “Software as a Service” model, and will host data and information. Kare4U will not review, share or distribute any such user data except as provided in the terms of use, or as may be required by law. Individual records of user’s data may be viewed or accessed only for the purpose of resolving a problem, support issues, or suspected violation of the terms of use, or as may be required by law. We would take all reasonable precautions for maintaining the confidentiality of data. We are not responsible for any breach of data (confidential or otherwise).

3. Payment, Fees, and Taxes:

3.1 – The company shall endeavor to provide customers with facilities/gateways to pay the fee through credit cards (American Express, Visa, and Mastercard), debit cards, cash cards and internet banking.

3.2 – It is understood and agreed by the user/customer that the services shall only commence after the realization of money in the accounts of the company in case online payment is being opted by them.

3.3 – It is understood and agreed by the user/customer that payment mechanisms may be governed by separate/additional terms of use, prescribed by the company.

3.4 – The Company reserves the right to refuse or cancel any order placed for a product/package that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or the payment has been levied via credit card. In the event the payment has been processed by the company, the same shall be credited to your credit card account within 7-14 working days and duly notified to you by email. Once the order has been placed and in case you wish to cancel/modify the same, you may do so. And be subject to cancellation/modification charges as prescribed.

3.5 – It is understood and agreed by the user/customer that payment mechanisms may be governed by separate agreements between the third parties who provide facilities for such payment mechanism and the company.

3.6 – It is understood and agreed by the user/customer that in no event whatsoever, the company shall take any responsibility or liability for malfunctioning or defect in any payment procedure. Payment of the price shall be the sole responsibility of the user/customer.

3.7 – The Company reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services through the website or any other fee. The company further reserves the right to alter any or all fees from time to time, without notice.

3.8 – The user/customer may be liable to pay all applicable charges, fees, duties, taxes, levies, and assessments for availing the services through the website. Further, the company reserves the right to change the fees upon its sole discretion without any prior notice to the customers/users.

3.9 – The fees could also be paid offline and be either collected personally from the user or to be mailed to Kare4U at the following address: Kare4U, at – Plot No. F/35, Chandaka Industrial Estate, Chandrasekharpur, Bhubaneswar, Dist-Khurda, Odisha, Pin-751024.

3.1.1 Payment Structure
Following are rates for various health packages available through Kare4U platform.
N.B. Please note that prices are subjected to change as per provider’s discretion

4. Refund Policy:

4.1 – Cancellation before 1 day of any appointment, 100% of the amount paid will be refunded.

4.2 – The E-Health Package is valid for “7 days” from the time and date of invoice generation. After 7 days, the customer shall not be entitled to claim for services and the company shall have the right to forfeit the fees already paid in such a case.

4.3 – Cancellation shall be acceptable only if the customer informs the company within 72 hours from the time of booking. 3% cancellation charges will be applicable to the total amount of invoice. The customer can contact us through E-mail ID kare@kare4u.in in case of cancellation and refund.

4.4 – The refund amount will be sent to the respective debit card/credit card/account from where payment was made. And the amount will not be refundable by any another mode

6. The need of Privacy Policy

6.1 – This privacy policy is published in compliance of: 
Section 43A of The Information Technology Act, 2000. 
Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules“).
Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

6.2 – This privacy policy states the following:
All type of information collected from the visitors and users of the website including sensitive personal data or information. The purpose, means, and modes of usage of such information, and how / to whom, Kare4U will disclose such information.

7. Personal information

7.1 – Personal information is defined under the SPI Rules; meaning, any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, and is capable of identifying such person. 

7.2 – The SPI Rules further define sensitive personal data or information of a person to mean personal information about that person relating to:
Passwords Financial information such as bank accounts, credit, and debit card details or other payment instrument details Physical, physiological and mental health condition Sexual orientation Medical records and history Biometric information Information received by body corporate under lawful contract or otherwise Visitor details as provided at the time of registration or thereafter Call data records

7.3 – Information that is accessible under the Right to Information Act, 2005 or any other law will not be regarded as sensitive personal data or information.

8. Privacy Statements 

8.1 – This section applies to all users. 

8.2 – Accordingly, a condition of each user’s use of and access to the website and to the Software provided by Kare4U to users (together with the website, the services) is their acceptance of the terms of use and also involves acceptance of the terms of this privacy policy. Any user who does not agree with any provisions of the same is required to leave the website immediately. 

8.3 – All the information provided to Kare4U by a User, including sensitive personal information, is voluntary. The user has the right to withdraw his/her/its consent at any time, in accordance with the terms of this privacy policy and the terms of use,but please note that withdrawal of consent will not be retroactive. Always be cautious while giving out any personally identifiable information about yourself or your family members in use of any services. Kare4U does not control or endorse the content, messages or information found in any services and therefore, Kare4U specifically disclaims any liability with regard to the services and any actions resulting from your participation in any services, and you agree to waive any claims against Kare4U relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against Kare4U relating to same. 

8.4 – User can access, modify, correct and eliminate the data about him/her/it which has been collected pursuant to his/her/its decision to become a user. If the user updates any of his/her/its information, Kare4U may keep a copy of the information which user has originally provided to Kare4U in its archives for uses documented herein. Kare4U takes User’s rights seriously and encourages the user to use them if user deems this to be appropriate. The user may exercise these rights by emailing Kare4U at Kare4U@Kare4U.in. 

8.5 – Kare4U may require the user to pay with a credit card, wire transfer, debit card or cheque. Kare4U will collect such user’s credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the user through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. The user is advised, however, that internet technology is not 100% safe and the user should exercise discretion on using the same. 

8.6 – Due to the communication standards on the internet, when a user visits the website Kare4U, the user automatically receives the URL of the site from which such user came and the site to which such user is going when he/she/it leaves. Kare4U also receives the Internet Protocol (IP) address of each user’s computer (or the proxy server that was used to access the World Wide Web), user’s computer operating system and type of web browser the used, email patterns, as well as the name of user’s ISP. This information is used to analyze overall trends to help Kare4U improve its service. The linkage between the user’s IP address and the user’s personally identifiable information is not shared with any third parties without the user’s permission or except when required by law. Notwithstanding the above, Kare4U may share some of the aggregate findings (not the specific data) with advertisers, sponsors, investors, strategic partners, and others in order to help and grow its business. 

8.7 – The Website uses temporary cookies to store certain data (that is not sensitive personal data or information), that is used by Kare4U and its service providers for technical administration of the website, research, and development. And for user administration. In the course of serving advertisements or optimizing services to its users, Kare4U may allow authorized third parties to place or recognize a unique cookie on the user’s browser. Kare4U does not store personally identifiable information in the cookies. 

8.8 – To create an account, the user is required to provide the following information, which such the user recognizes and expressly acknowledges is personal information allowing others, including Kare4U, to identify the username, user ID, email address, country, ZIP/postal code, age, phone number, password chosen by the user and a valid financial account information. Other information requested on the registration page, including the ability to receive promotional offers from Kare4U, is optional. Kare4U may, in future, include other optional requests for information from the user to help Kare4U to customize the website and deliver personalized information to the user. Without the user’s consent, Kare4U will not share, rent or sell any personal information with third parties, in any way other than what is disclosed in this privacy policy. 

8.9 – Kare4U allows other companies to serve advertisements to the users.These companies include but are not limited to third-party ad servers, ad agencies, ad technology vendors and research firms. Kare4U may display advertisements to users that fit certain general profile criteria (targets). Kare4U does NOT use the personally identifiable information to identify targets for advertising on its services. 

8.10 – This privacy policy applies to services that are owned and operated by Kare4U. Kare4U does not exercise control over the sites displayed as search results or links from within its services. These other sites may place their own cookies or other files on the user’s computer, collect data or solicit personal information from the user, for which Kare4U is not responsible or liable. Accordingly, Kare4U does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Kare4U guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by Kare4U of the website, the website provider, or the information on the website. Kare4U encourages the user to read the privacy policies of the website. 

8.11 – The Website may enable the user to communicate with other users or to post information to be accessed by others, whereupon other users may collect such data. Such users, including any moderators or administrators, are not authorized Kare4U representatives or agents, and their opinions or statements do not necessarily reflect those of Kare4U, and they are not authorized to bind Kare4U to any contract. Kare4U hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by users or visitors in such a manner.

8.12 – Kare4U does not collect information about the visitors of the website from other sources, such as public records or bodies, private organizations, save and except for the purposes of registration of the users (the collection, storage, and disclosure of which each end user must agree to under the terms of use in order for Kare4U to effectively render the Services). 

8.13 – Kare4U does not knowingly collect personal data from children. However, for maintaining Personal Health Records (PHR) of their children, parents (users) can add the vaccination and other health-related information for keeping records.

8.14 – Kare4U has implemented Indian legal industry standard security policies, rules and technical measures to protect personal data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. 

8.15 – Kare4U will not disclose any personal information or data to governmental institutions or authorities unless such disclosure is requisitioned under any Indian law or judicial decree or when Kare4U, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply our terms of use. 

8.16 – Kare4U addresses any discrepancies and grievances of all users with respect to the processing of information in a time-bound manner. For this purpose, Kare4U has designated Anuraag Dubey as the grievance officer, who will redress the grievances of the users, expeditiously within a maximum of one month from the date of receipt of the grievance, and who can be reached by: Sending a letter marked to the address: Kare4U at – Plot No. F/35, Chandaka Industrial Estate, Chandrasekharpur, Bhubaneswar, Dist-Khurda, Odisha, Pin-751024; or By sending an email to Kare4U@Kare4U.in.

9. Provider’s Note:

9.1 – This section is applicable to the providers.

9.2 – As a part of the registration/application creation and submission process that is available to the providers on the website, certain information, including sensitive personal data or information is collected from the providers. 

9.3 – All the statements in this privacy policy apply to all the providers. And all providers are therefore required to read and understand the privacy statements set out herein prior to submitting any sensitive personal data or information to Kare4U, failing which they are required to leave this website immediately. 

9.4 – Providers personally identifiable information they choose to provide on the website is used to help the providers describe/identify themselves.This information is exclusively owned by Kare4U. Kare4U may use such information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. 

9.5 – Kare4U automatically lists information of providers on its website, every time a new provider starts using its software. The provider information listed on the website is displayed when users search for doctors on the website and the provider information listed on the website are used by users to request for a doctor’s appointment. Kare4U, on its own, does not list any personally sensitive information of such providers. 

9.6 – However, Kare4U does not hold any liability for any incorrect or incomplete information appearing on the website for such providers.

10. User’s Note:

10.1 – This section is applicable to the consumer (patients). 

10.2 – As a part of the registration/application, creation and submission process that is available to the consumer on this website, certain information, including sensitive personal data or information is collected from the users. 

10.3 – All the statements in this privacy policy apply to all consumers, and all consumers are therefore required to read and understand the privacy statements set out herein prior to submitting any sensitive personal data or information to Kare4U, failing which they are required to leave this website immediately. 

10.4 – If the consumers have inadvertently submitted any such information to Kare4U prior to reading the privacy statements set out herein, or does not agree with the manner in which such information is collected, stored or used, then the same may be modified or deleted by the consumer by using options provided on the Website. In addition, any user can ask Kare4U, by sending a written request by sending a letter marked to the address: Kare4U at – Plot No. F/35, Chandaka Industrial Estate, Chandrasekharpur, Bhubaneswar, Dist-Khurda, Odisha, Pin-751024; or an email to Kare4U@Kare4U.in whether Kare4U is keeping personal data about him/her, and every Consumer is also entitled to require Kare4U to delete and destroy all such information relating to him/her (but not other Users) in its possession. 

10.5 – The personally identifiable information that the consumers choose to provide on the website is used to help them describe/identify themselves. Other information that does not personally identify the consumer as an individual, is collected by Kare4U from them (such as, patterns of utilization described above) and is exclusively owned by Kare4U. Kare4U may also use such information in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. If Kare4U wishes to use any consumer’s personal data for a new purpose, it will seek consumer’s permission before doing so by trying to contact the customer in good faith. 

10.6 – Kare4U will communicate with the consumer through email, phone, and notices posted on the website or through other means available through the service, including text and other forms of messaging based on the consumer’s contact preferences. The consumers can change their e-mail and contact preferences at any time by logging into their account at www.Kare4U.in and change their account settings. 

10.7 – At times, Kare4U conducts a consumer survey to collect information about the consumer’s preferences. These surveys are optional and if consumers choose to respond, their responses will be kept anonymous. Similarly, Kare4U may offer contests to qualifying consumers/patients in which we ask for contact and demographic information such as name, e-mail address, mailing address or any other relevant information. None of this information is shared with the third parties, except in summary form, if at all. The demographic information that Kare4U collects in the registration process and through surveys is used to help Kare4U improve its services to meet the needs and preferences of the consumers. This may include targeting advertising to consumers about our services. Information gathered through a contest may also be disclosed to third parties, as necessary, for prize fulfillment and other aspects of any contest or similar offering. 

10.8 – Kare4U may keep records of telephone calls received for making appointments or other purposes for the purpose of administration of services, research and development and for consumer administration. 

10.9 – All Kare4U employees and data processors, who have access to and are associated with the processing of sensitive personal data or information, are obliged to respect the confidentiality of every consumer’s sensitive personal data and information. 

10.10 – Kare4U may also disclose or transfer consumer’s personal and other information the user provides, to another third party as part of reorganization or a sale of the assets of a Kare4U corporation division or company. Any third party to which Kare4U transfers or sells its assets will have the right to continue to use the personal and other information that the consumers provide. 

10.11 – Same as set out above, Kare4U only uses the personal data or information collected from the consumers in the manner set out in the section relating to the registration process below. Kare4U may also use such information in an aggregated or non-personally identifiable form for research, statistical analysis, and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable forms to third parties and affiliates. If Kare4U wishes to use any consumer’s personal data for a new purpose, it will seek such consumer’s permission before doing so. 

10.12 – To the extent necessary to provide consumers with the services on the website, Kare4U may provide their personal information to the third party contractors who work on behalf of or with Kare4U to provide them with such services, to help Kare4U communicate with consumers or to maintain the website. Generally, these contractors do not have any independent right to share this information, however, certain contractors who provide services on the website, including the providers of online communications services, will have rights to use and disclose the personal information collected in connection with the provision of these services in accordance with their own privacy policies.

11. Casual Visitors Note:

11.1 – No sensitive personal data or information is automatically collected by Kare4U from any casual visitors of this website, who are merely perusing the site. 

11.2 – Nevertheless, certain provisions of this privacy policy are applicable to even such casual visitors, and such casual visitors are also required to read and understand the privacy statements set out herein, failing which they are required to leave this website immediately. 

11.3 – Any casual visitor who has willingly submitted any personal data or information to Kare4U through any means, including e-mail, post or through the registration process on the website. All such visitors will be deemed to be and will be treated as, end users for the purposes of this privacy policy, and in which case, all the statements in this privacy policy applicable to such persons.

12. Registration Process

12.1 – As a part of the registration process, Kare4U collects the following personal information from Consumer:

12.2 – All information listed in S.12.1 of this privacy policy user information is maintained by Kare4U in electronic form on its equipment, and on the equipment of its employees. End-user information may also be converted to physical form from time to time. Regardless of the manner of storage, Kare4U will keep all end-user information confidential, and will only disclose end user information. 

12.3 – Kare4U makes all consumer information accessible to its employees only on a need-to-know basis, and binds all such employees to strict confidentiality obligations. 

12.4 – Part of the functionality of the software is assisting the providers to maintain and organize such information. Kare4U may, therefore, retain and submit all such records to the appropriate authorities, or to providers who request access to such information. 

12.5 – Part of the functionality of the software is assisting the consumer to access information relating to them. Kare4U may, therefore, retain and submit all such records to the relevant users, or to their providers (doctors, hospitals, medical labs, blood banks). 

12.6 – Notwithstanding the above, Kare4U shall not be responsible for any breach of security or for any actions of any third parties that receive consumer’s personal data or events that are beyond the reasonable control of Kare4U including, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security, encryption, etc.

13. Change to Privacy Policy:

13.1 – The consumer acknowledges that this privacy policy is part of the terms of use and unconditionally agree that, becoming a consumer of the website and its services signifies their assent to this privacy policy. Consumer’s visit and any dispute over privacy are subject to this policy and terms of use. Kare4U may update this privacy policy at any time, with or without an advance notice. In the event, there are significant changes in the way Kare4U treats the consumer’s personally identifiable information, Kare4U will display a notice on the website or send consumers an e-mail, as provided for above. Unless stated otherwise, Kare4U”s current privacy policy applies to all information that Kare4U has about consumers and their account. Notwithstanding the above, Kare4U shall not be required to notify the consumers of any changes made to the privacy policy. Please check this page regularly to ensure you are familiar with the current version.

13.2 – If a consumer uses the service after the notice of changes have been sent to such consumer or published on the website, such consumer hereby provides his/her/its consent to the changed policies/practices.

This website is provided “as is” without any representations or warranties, express or implied. Kare4U software/website makes no representations or warranties in relation to this website or the information and materials provided on this website.Without prejudice to the generality of the foregoing paragraph, Kare4U software/website does not warrant that: This website will be constantly available, or available at all. The information on this website is complete, true, accurate or non-misleading.Nothing on this website constitutes or is meant to constitute, the advice of any kind. If you require advice in relation to any legal, financial or medical matters,you should consult an appropriate professional.

15. Limitations of Liability
Kare4U will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with this website: To the extent that the website is provided free-of-charge, for any direct loss. For any indirect, special or consequential loss. For any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data. These limitations of liability apply even if Kare4U has been expressly advised of the potential loss.

16. Reasonableness
By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

17. Unenforceable Provisions
If any provision of this website disclaimer is or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.
